Upon researching the United States Supreme Court Justices, I discovered that Harvard Law School is where many attended (nineteen to be exact). The schools where most of the Justices attended were Harvard, Yale, and Columbia. I enjoyed reading about Justice Curtis and Justice McLean. Both seem to defy conformity. They formulate a decision based on their own interpretation of the law and given freedom.
Judicial Review is a great power for our legal system, however, I believe if overused it could lose its meaning. If we allow it to be overused, it could reach the point that citizens or courts could use this power to constantly manipulate and adjust the laws and standards to suit the needs of those on a specific side of a case. There must be a reasonable line drawn and it should be followed appropriately.
I believe the intent of the framers of the Constitution should be followed as best as possible, however it is very obvious that they were not always correct. It was a very different time back then, and things in society were much more strict. As with judicial review, I believe there is a middle ground that must be reached. Although society continues to evolve, classic standards should be followed as long as freedoms remain intact and equality remains as well.

Great job, the framers were not always correct but they were more or less creating a plan, executing it and seeing what happens next, they did i believe the better interests in mind
ReplyDeleteI too think judicial review is a great power of the judicial branch. I also believe it should not be overused. I also believe that it should be use regularly, not too much though. The judicial review is what checks the executive and legislative branch. I think it is part of the check and balance of government. If the Judicial branch did not get to use this power, I think there would be argument that the other two branches has more power. The power is suppose to be equal.
ReplyDeleteI too believe that judicial review is a great power possessed by the judicial branch and believe that it should be exercised regularly. I do believe that the framers established the constitution to lay out a plan for our government and left room for the constitution to grow and evolve along with society.
ReplyDeleteWow, I had no idea that that many Justices went to Harvard. It seems like presidents are in favor or Harvard alumni, haha! I think that judicial review would be very bad if it were abused. I agree that there needs to be a line that should not be crossed. I love your answer to question 3 because I never thought if it that way! Great response!
ReplyDeleteI also noticed that most of the Justices attended Harvard. They also have a lot of experience with law, which seems pretty obvious but is so important to the system. I like that they all have been involved with the law system for awhile. This makes it seem like they are very qualified.
ReplyDeleteThat interesting that so many of them had gone to Harvard, it isnt really surprising though.When I think about Harvard I automatically think about Law and that would probably be one of the best places to go to learn about it. I agree with you I think that the supreme court should stay as close to the constitution as possible. It is important to the United State of America to keep the laws and rules that way people cant come in and change it to the way they would like for it to be.
